29 CFR 1910.305(e)(1): Cabinets, cutout boxes, fittings, boxes, and panelboard enclosures in damp or wet locations shall be installed so as to prevent moisture or water from entering and accumulating within the enclosures and shall be mounted so there is at least 6.35-mm (0.25-in.) airspace between the enclosure and the wall or other supporting surface. However, nonmetallic enclosures may be installed without the airspace on a concrete, masonry, tile, or similar surface. The enclosures shall be weatherproof in wet locations. a) On or about August 23, 2024, the employer did not ensure the equipment used in the electrical installation of the wash bay building, that includes but is not limited to the Square D QO24L70RB cabinet, fittings, and square metal 4" x 4" boxes, were installed so as to prevent moisture or water from entering and accumulating within the enclosures.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. a) On or about August 23, 2024, the employer did not provide effective information or training prior to initial work assignments regarding the sections of a safety data sheet, labeling requirements, and pictograms prior to working with hazardous chemicals to include but not limited to Car Brite ALL SOL Body Prep Solvent, Wheel Brite, Car Brite Break Down Bug Remover, and BlackFire Pro Tire Dressing in the carwash area.
