29 CFR OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of being struck-by or caught-in between operating motor vehicles and equipment: a) Live load-unload area at 55 Hosier Street, Selbyville, DE 19966: On or about 8/29/2024, employees were exposed to multiple hazards onsite including but not limited to struck by/caught in hazards when they performed flagging operations approximately 16 hours a day every 20 to 24 minutes to facilitate tractor trailers to back across two lanes of active traffic without the use of required signage warning of the frequent road closure ahead, required training for employees to conduct active roadway closure, as well as the stop sign being used not meeting the size requirement to stop active traffic.
