29 CFR 1910.178(p)(1):  Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition.  On or about 9/6/2024, the employer failed to ensure that a forklift (Make: Hyster, Model: J35XNT, Serial # K160N03063L) was not removed from service after being informed the forks were not properly raising and lowering.   The Hyster forklift did have the keys in it, the battery was attached, and did not have any signage indicating for it to not be used by employees. The forklift had not been restored to a safe operating condition.
