29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a) On or before 9/9/2024,  Bergman KPRS LLC as the controlling employer did not ensure that the trenches where subcontractor employees were working were protected from cave-in hazards. The trench to the north was 10 feet deep and 6 feet wide while the south trench was 10.5 feet deep and 4 feet wide. The trenches were equipped with modular trench boxes with protection only along the long axes, with the short axes exposed to vertical walls of sandy soil. The subcontractor employee was adjacent to a vertical dirt wall shoveling away material that had sloughed away from the wall.
