29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) and as referenced by the note contained in 1926.602(d):  a) Jobsite located at 2743 South 3rd Street, Philadelphia, PA 19148 - On or about September 10, 2024, the employer did not ensure that the powered industrial truck (PIT) operator operating PITs such as, but not limited to, Toyota Forklift Truck, Model 8FGCSU20, successfully completed training and evaluation to ensure the operator has the knowledge and skills needed to operate the powered industrial trucks safely, thereby exposing employees to caught in-between and fall hazards.  Training shall consist of a combination of formal instruction, practical training, and evaluation of the operator's performance in the workplace.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  a) Jobsite located at 2743 South 3rd Street, Philadelphia, PA 19148 - On or about September 10, 2024, the employer allowed employees to work on pallets on the forks of a powered industrial truck that was being used as a work platform that was not specifically designed by the manufacturer for such use.   Employees were removing signs on the side of a building, while working on top of pallets on the forks of a powered industrial truck, exposing employees to falls of approximately 17 feet.

29 CFR  1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  a) Jobsite located at 2743 South 3rd Street, Philadelphia, PA 19148 - On or about September 10, 2024, the employer did not ensure that employees working on an elevated platform were provided fall protection systems or guard rail systems.  Employees were removing signs on the side of a building while working on top of pallets on the forks of a powered industrial truck without the use of fall protection, thereby exposing employees to falls of approximately 17 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Jobsite located at 2743 South 3rd Street, Philadelphia, PA 19148 - On or about September 10, 2024, the employer did not provide effective training to employees who was exposed to fall hazards during commercial construction activities.  Employees were removing signs on the side of a building, while working on top of pallets on the forks of a powered industrial truck without fall protection training, thereby exposing employees to falls of approximately 17 feet.
