29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions:  (a)Split Rock Landscaping and Nursery, Inc. at SD 37 approximately one-half mile south of 251st Street in Mitchell, SD 57301:  On or about and at times prior to September 17, 2024, the employer did not ensure a competent person inspected the excavation prior to start of work and during each shift, in that the competent person did not identify current soil conditions, did not identify the need for a trench protective system, and did not ensure appropriate protective system was in place prior to an employee entering the excavation.  This condition exposed the employee to struck-by and crushed-by hazards when performing work in the unprotected excavation at an approximate depth of 19-feet.  Abatement Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are hazardous or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
