29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  (a)Split Rock Landscaping and Nursery, Inc. at SD 37 approximately one-half mile south of 251st Street in Mitchell, SD 57301:  On or about and at times prior to September 17, 2024, the exposing employer did not ensure that employees were trained to recognize and avoid unsafe conditions such as vibrations, forming fissures, lack of egress, sloughing, etc. while conducting trenching operations.  This condition exposed employees to various hazards associated with excavation work and construction activities.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  (a)Split Rock Landscaping and Nursery, Inc. at SD 37 approximately one-half mile south of 251st Street in Mitchell, SD 57301:  On or about and at times prior to September 17, 2024, the exposing employer did not ensure employees that were entering an excavation greater than four feet in depth were provided with a safe means of egress not requiring more than 25 feet of travel.  This condition exposed employees to hazards associated with safe egress while working within an unprotected excavation.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions:  (a)Split Rock Landscaping and Nursery, Inc. at SD 37 approximately one-half mile south of 251st Street in Mitchell, SD 57301:  On or about and at times prior to September 17, 2024, the employer did not ensure a competent person inspected the excavation prior to start of work and during each shift, in that the competent person did not identify current soil conditions, did not identify the need for a trench protective system, and did not ensure appropriate protective system was in place prior to an employee entering the excavation.  This condition exposed the employee to struck-by and crushed-by hazards when performing work in the unprotected excavation at an approximate depth of 19-feet.  Abatement Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are hazardous or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a)Split Rock Landscaping and Nursery, Inc. at SD 37 approximately one-half mile south of 251st Street in Mitchell, SD 57301:  On or about and at times prior to September 17, 2024, the exposing employer did not ensure that employees conducting retaining wall installation operations within an unprotected excavation greater than five feet in depth were protected from excavation wall cave-in by an adequate protective system.   This condition exposed employees to struck-by and cave-in hazards associated with an excavation wall collapse.
