29 CFR 1910.333(b)(2): "Lockout and Tagging." While any employee is exposed to contact with parts of fixed electric equipment or circuits which have been deenergized, the circuits energizing the parts shall be locked out or tagged or both in accordance with the requirements of this paragraph. The requirements shall be followed in the order in which they are presented (i.e., paragraph (b)(2)(i) first, then paragraph (b)(2)(ii), etc.). Note 1: As used in this section, fixed equipment refers to equipment fastened in place or connected by permanent wiring methods. Note 2: Lockout and tagging procedures that comply with paragraphs (c) through (f) of 1910.147 will also be deemed to comply with paragraph (b)(2) of this section provided that: [1] The procedures address the electrical safety hazards covered by this Subpart; and [2] The procedures also incorporate the requirements of paragraphs (b)(2)(iii)(D) and (b)(2)(iv)(B) of this section.   On or about September 19, 2024, the employer did not ensure that a lockout device was affixed to the energy isolating device before service and/or maintenance activities were performed on a 60-Amp, 600V, 3-Pole Square-D Heavy Duty Safety Switch for a fan at the bottom of Grain Bin/Tank 6. Employees were exposed to electrical shock related injuries such as severe burns to skin and internal tissues, musculoskeletal injuries, and amputations which could result in permanent disability or death.  Abated during inspection.

29 CFR 1910.303(f)(2): Services, feeders, and branch circuits. Each service, feeder, and branch circuit, at its disconnecting means or overcurrent device, shall be legibly marked to indicate its purpose, unless located and arranged so the purpose is evident.  On or about September 19, 2024, the employer did not ensure that each service, feeder, and branch circuit, at its disconnecting means or overcurrent device, was legibly marked to indicate its purpose. Employees were exposed to electric shock hazards which could result in severe injuries such as burns, amputations, and cardiac arrest.  The following instances were observed: (a) A large, double door, high voltage electrical disconnect located near the bottom of a grain tank/bin and the Rail Distribution Dryer was observed to have no labeling or marking to indicate its purpose. (IMG_4005) (b) Multiple EATON 60A, 600V AC, 60 Hz, 250 V DC electrical disconnects located at the bottom of the grain tanks/bins in line with each other were observed to have no labeling or marking to indicate their purpose. These were mounted on the tank located near fan motors and the no entry sweep panels. (IMG_3982; IMG_4036; IMG_4043; IMG_4048; IMG_4049)  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.305(b)(2)(i): All pull boxes, junction boxes, and fittings shall be provided with covers identified for the purpose.  On or about September 19, 2024, the employer did not ensure all pull boxes, junction boxes, and fittings shall be provided with covers identified for the purpose.  The following instances were observed: (a)	Two service junction boxes south of the Truck unloading, East of Grain Bin/Tank 1, and near the bottom of the dry leg conveyor were observed to have no labeling or marking to indicate their purpose.  (b)	A service junction box on the back side of a grain bin/tank with conduit running towards the bin sweep was observed to have no labeling or marking to indicate their purpose. There were three conduit lines ran underground feeding into the bottom, two feeding out of the top, and conduit lines coming out of both sides.  (c) A service junction box on the side of a grain bin/tank with conduit lines running to a disconnect for a fan motor, and two conduit lines running from each side of the box was observed to have no labeling or marking to indicate their purpose.  (d) A service junction box mounted at the bottom of Grain Bin/Tank 5 with conduit running up into the bottom and out of one side was observed to have no labeling or marking to indicate their purpose. (Instance (d) was abated during the inspection). (e) A service junction box mounted at the bottom of Grain Bin/Tank 3 with three conduit lines running into the bottom, two out of one side, and one out of the top was observed to have no labeling or marking to indicate their purpose. (Instance (e) was abated during the inspection).  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

On or about September 19, 2024, the employer did not ensure sufficient access and working space was provided and maintained about all electric equipment in the High Voltage room/substation to permit ready and safe operation and maintenance of such equipment. Employees are exposed to fire and shock related hazards which could result in life altering injuries and illnesses or death in the event of an emergency and equipment could not quickly and safely be accessed.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.303(h)(3): Work space about equipment. Sufficient space shall be provided and maintained about electric equipment to permit ready and safe operation and maintenance of such equipment. Where energized parts are exposed, the minimum clear work space may not be less than 1.98 m (6.5 ft) high (measured vertically from the floor or platform) or less than 914 mm (3.0 ft) wide (measured parallel to the equipment). The depth shall be as required in paragraph (h)(5)(i) of this section. In all cases, the workspace shall be adequate to permit at least a 90-degree opening of doors or hinged panels.   On or about September 19, 2024, the employer did not ensure sufficient access and working space was provided and maintained about all electric equipment over 600V in the High Voltage room/substation to permit ready and safe operation and maintenance of such equipment. Employees are exposed to fire and shock related hazards which could result in life altering injuries and illnesses or death in the event of an emergency and equipment could not quickly and safely be accessed.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.106(d)(3)(ii):"Fire resistance." Storage cabinets shall be designed and constructed to limit the internal temperature to not more than 325 deg. F. when subjected to a 10-minute fire test using the standard time-temperature curve as set forth in Standard Methods of Fire Tests of Building Construction and Materials, NFPA 251-1969, which is incorporated by reference as specified in Sec. 1910.6. All joints and seams shall remain tight, and the door shall remain securely closed during the fire test. Cabinets shall be labeled in conspicuous lettering, "Flammable - Keep Fire Away."  On or about September 19, 2024, the employer did not ensure flammable aerosols and flammable liquids, such as but not limited to WD-40 and gasoline, were stored in fire resistant cabinets. Employees were exposed to fire related hazards and injuries such as severe burns and smoke inhalation which could result in permanent disability or death.  The following instances were observed: (a) In the high voltage substation there were various flammable aerosols stored on and around electrical cabinets, such as but not limited to multiple cans of WD-40, "Do it Best" Enamel, NAPA Mac's 1397 Belt Dressing, and NAPA Ignition & Battery Sealer (IMG_4094) (b) In the Frary lumber storage area, flammable liquids, such as gasoline, were observed stored along the walls near lumber and other materials in cardboard boxes. (IMG_4147; IMG_4148) (c) In the Frary lumber storage area, various flammable aerosols and flammable liquids were observed stored on a wooden table/work bench. Items such as, but not limited to, Champion Air Brake Anti-Freeze, Orange Spray Paint, Do It Best Propane bottles (14.1 oz) and at least one with the torch kit installed, CRC Industries Battery Terminal Protector bottles, and Liquid Wrench Penetrating Oil spray can.
