29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).   a) On or about 09/24/2024; At the jobsite located at 613 Fairground Road, Muscle Shoals, AL; the employer failed to frequently or regularly inspect the jobsite to protect employees from construction hazards such as but not limited to falls,  caught-in or- between, struck by and electrocution hazards.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

On or about 09/24/2024 - At the jobsite located at 613 Fairground Road, Muscle Shoals, AL: The employer exposed employees to fall hazards, in that fall protection was not utilized by employees performing installation of trusses at heights between approximately 6 and 12 feet.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).   (a): On or about September 24, 2024, the employer did not certify that forklift operator(s) had been trained and evaluated as required by paragraph (l) with certification records. An employee was operating a JLG 6042 T4F Telehandler Forklift to deliver roof trusses to the top of a new construction building, approximately 11.4 feet above the lower level.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
