OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee was exposed to a crushing or caught-in between hazard:  a) Jobsite, 23 Happy Valley Rd, Nampa, ID 83687: On September 22, 2024, an employee placed himself under a Cadillac CTS while in the process of removing the vehicle from the roll bed of a 2022 Mack Model MD (VIN# 1M2MDBAA8NS002482) tow truck. This exposed the employee to the hazard of vehicle movement and crushing injuries during unloading.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident.  a) Jobsite, 23 Happy Valley Rd, Nampa, ID 83687: On September 22, 2024, an employee was fatally crushed while working under a vehicle that was in the process of being lowered off the roll bed of a car carrier. The fatality was not reported to OSHA until September 24, 2024.
