OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  a.) At the worksite, located at 100 Circuit Road Nokomis, FL 34275; On or about 9/25/24, the employer exposed employees to struck by hazards in that, boats were staged and stored on racking systems that contained defective wooden center beams during marina operations.

29 CFR  1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  a.) At the worksite, located at 100 Circuit Road Nokomis, FL 34275; On or about 9/25/24, the employer exposed employees to fall hazards of approximately 20 ft and struck by hazards in that, a modified and unapproved forklift platform attachment was used to service boat racking systems.

At the worksite, located at 100 Circuit Road Nokomis, FL 34275; On or about 9/25/24, the employer exposed employees to struck by hazards in that, employees were operating a Wiggins Marina Bull Lo Pro forklift without receiving formal instruction, hands on trainings, evaluations or certifications.
