On or about October 2, 2024, California Exteriors LLC did not ensure that four employees working from the ground level below roofing activities were protected from falling or flying objects by utilizing protective helmets in a worksite at 1131 O'Fallon Lakes Drive in O'Fallon, Missouri.

29 CFR  1926.20(b)(2): Such programs had not provided for frequent and regular inspections of the job sites, materials, and equipment to have been made by competent persons designated by the employers.  On or about October 2, 2024, California Exteriors LLC did not ensure that adequate frequent and regular inspections of the job site by competent persons designated by the employer had occurred at 1131 O'Fallon Lakes Drive in O'Fallon, Missouri, thus exposing employees  to the following hazards:  A) Three employees were exposed to fall hazards from roofing a three-story apartment building without utilizing fall protection. B) Three employees were exposed to fall hazards from utilizing a portable extension ladder that was not properly positioned. Employees were not provided a grasping device, such as a grabrail, to assist them in mounting and dismounting the ladder. C) Four employees were exposed to struck-by and falling object hazards from working on the lower level, below roofing activities, without head protection.  REPEAT Rafael Ortiz DBA Cardinal Exteriors LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.20(b)(2), which was contained in OSHA inspection number 1688182, citation number 1, item number 1b and was affirmed as a final order on August 11, 2023, with respect to a workplace located at 13 J C Drive in Swansea, Illinois.

On or about October 2, 2024, California Exteriors LLC did not ensure that three employees roofing a steep roof, above three stories, were protected from falling by the use of guardrail systems with toeboards, safety net systems, or personal fall arrest systems at 1131 O'Fallon Lakes Drive in O'Fallon, Missouri.  REPEAT Rafael Ortiz DBA Cardinal Exteriors LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(11), which was contained in OSHA inspection number 1708110, citation number 1, item number 1b and was affirmed as a final order on April 4, 2024, with respect to a workplace located at 140 Venita Drive in O'Fallon, Illinois.  Rafael Ortiz DBA Cardinal Exteriors LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1688182, citation number 2, item number 1 and was affirmed as a final order on August 11, 2023, with respect to a workplace located at 13 J C Drive in Swansea, Illinois. 29 CFR  1926.1053(b)(1): When portable ladders had been for access to an upper landing surface, the ladder side rails had not extended at least 3 feet (.9 m) above the upper landing surface to which the ladder had been used to gain access; or, when such an extension had not been possible because of the ladder's length, then the ladder had not been secured at its top to a rigid support that would not deflect, and a grasping device, such as a grabrail, had not been provided to assist employees in mounting and dismounting the ladder.  On or about October 2, 2024, California Exteriors LLC did not ensure that a portable ladder used to access the roof of a three-story apartment building at 1131 O'Fallon Lakes Drive in O'Fallon, Missouri, was properly positioned. The ladder's extension was not possible because of the ladder's length, and the employer did not provide a grasping device to assist employees in mounting and dismounting the ladder, thus exposing four employees to fall hazards.
