29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. On or about October 2, 2024, an employee was not wearing a hard hat wile performing trenching operations where overhead hazards existed, exposing the employee to the struck by hazards. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. On or about October 2, 2024, an employee was not provided with a safe means of access to a trench, exposing the employee to the hazards associated with no safe access to a 5 foot trench. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. On or about October 2, 2024, the employer failed to ensure a competent person conducted daily inspections of the site excavation, exposing employees to struck-by hazards. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

On or about October 2, 2024, traffic control devices (sign) did not conform to Part 6 of the MUTCD and did not notify approaching drivers of workers within the traveled way, exposing employees to struck-by hazards.
