29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about 10/04/2024 - Lot 19, Fame Avenue, Tuscumbia, AL: The employer exposed employees to fall hazards, in that fall protection was not utilized by employees performing framing activities at approximately 13 feet.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

(a) On or about 10/04/2024 - Lot 19 Fame Avenue, Tuscumbia, AL: The employer exposed employees to fall hazards, in that fall protection was not provided to employees while engaged in residential framing activities at height of more than 6 feet.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a) At Lot 19, Fame Avenue, Tuscumbia, AL, On or about October 4, 2024: The employer exposed employees to fall hazards, in that the ladder side rails were not extended 3 feet above the landing surface, nor was the portable ladder secured properly.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
