29 CFR  1910.134(e)(6)(i): Obtain a written recommendation regarding the employee's ability to use the respirator from the PLHCP. The recommendation shall provide only the following information:   1910.134(e)(6)(i)(A) Any limitations on respirator use related to the medical condition of the employee, or relating to the workplace conditions in which the respirator will be used, including whether or not the employee is medically able to use the respirator;  1910.134(e)(6)(i)(B) The need, if any, for follow-up medical evaluations; and  1910.134(e)(6)(i)(C) A statement that the PLHCP has provided the employee with a copy of the PLHCP's written recommendation.  a.) On or about October 8, 2024, employees required to wear N95 filtering facepiece respirators did not each receive a written recommendation from a PLHCP regarding the employee's ability to use the respirator that included any limitations on respirator use, any need for follow-up medical evaluations, and a statement that the PLHCP provided the employee with a copy of the PLHCP's written recommendation.

The OSHA-accepted QLFT and QNFT protocols and procedures are contained in Appendix A of this section.   a.) On or about October 8, 2024, the employer did not ensure employees required to wear a N95 filtering facepiece respirator when providing care for residents with COVID were clean shaven and did not have facial hair between the sealing surface of the facepiece when administering a qualitative fit test.

The employer shall not permit respirators with tight-fitting facepieces to be worn by employees who have: Facial hair that comes between the sealing surface of the facepiece and the face or that interferes with valve function.  a.) On or about October 8, 2024, the employer did not ensure employees required to wear a N95 filtering facepiece respirator when providing care for residents with COVID were clean shaven and did not have facial hair between the sealing surface of the N95 filtering facepiece respirator.
