29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) Top plate, Lot 25: On or about 10/17/2024, and at times prior, the employer exposed employees to fall hazards of approximately 9-feet, 11-inches to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities.   b) Top plate, Lot 27: On or about 10/17/2024, and at times prior, the employer exposed employees to fall hazards of approximately 9-feet, 9-inches to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities.

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided:  a)Top plate, Lot 25: On or about 10/17/2024, and at times prior, the employer exposed employees to fall hazards of approximately 9-feet, 11-inches to the lower level, in that a 5-foot ladder was provided for access and egress from the first story, leaving employees to rely on 2x4 wall braces.  b) Top plate, Lot 27: On or about 10/17/2024, and at times prior, the employer exposed employees to fall hazards of approximately 9-feet, 9-inches to the lower level, in that a 5-foot ladder was provided for access and egress from the first story, leaving employees to rely on 2x4 wall braces.
