29 CFR 1910.1053(d)(4): The employer did not reassess exposures whenever a change in the production, process, control equipment, personnel, or work practices was reasonably expected to result in new or additional exposures at or above the action level, or when the employer had reason to believe that new or additional exposures at or above the action level have occurred: a) Cement Mixer #1 (pipe side); October 22, 2024, and at times prior thereto, the employer failed to assess the employee cleaning the new cement mixer to determine their 8-hour TWA exposure. An employee using a jackhammer/chipping tool to remove concrete from mixer #1 was exposed to respirable crystalline silica hazards at 41.69 micrograms per cubic meter which is approximately 1.66 times the Action Level (AL) of 25 micrograms per cubic meter, and the employer did not perform monitoring of the job task or work area after the previous mixer of a different configuration was replaced. Results were based on a 508-minute sampling period.
