29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: On or about October 25, 2024, employees of JTL Landscaping LLC, dba: JTL, were working inside a trench located at the intersection of Highway Z and N in Wentzville, Missouri. The employer did not ensure the competent person performed an inspection of the trench area prior to employees entering the trench. The employees were exposed to engulfment and struck-by hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation is not being protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): On or about October 25, 2024, employees of JTL Landscaping LLC, dba: JTL, were working in a trench located at the intersection of Highway Z and N in Wentzville, Missouri. The employer did not ensure employees working in a trench measuring approximately 6 feet deep, 4.5 feet wide and 28 feet long were protected by implementing a protective system, benching, sloping or shoring. The employees in the trench were exposed to engulfment and struck-by hazards.

29 CFR 1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face: On or about October 25, 2024, employees of JTL Landscaping LLC, dba: JTL were installing underground pipe at a jobsite located at the intersection of Highway Z and N in Wentzville, Missouri. The employer did not provide protective barriers or scale the face wall of loose material. The employees in the trench were exposed to struck-by hazards while working directly under a tension crack/fissure in the Southeast trench wall.
