29 CFR 1910.146(c)(5)(ii)(C): Employees entered into permit spaces that met the conditions set forth in 29 CFR 1910.146(c)(5)(i) but before an employee entered the space, the internal atmosphere was not tested with a calibrated direct-reading instrument: a) 1035 Belleville Turnpike, Kearny, NJ-Portal North RR Bridge Replacement Project (Ballast Tanks-End of CAP 2 of Deck Spud Barge "SKANSKA 460012"): Employees were required to enter various permit-required confined spaces (ballast tanks/Mid-body Compartment) to conduct visual internal inspections for damage and structural integrity. The employer did not ensure that the internal atmosphere of the ballast tanks were tested with a calibrated direct-reading instrument prior to entering a permit-required confined space, thus exposing employees to a hazardous atmosphere, on or about 10/29/24.

29 CFR 1910.146(c)(5)(ii)(E)(1): Employees entered into permit spaces that met the conditions set forth in 29 CFR 1910.146(c)(5)(i) but continuous forced air ventilation was not used to eliminate any hazardous atmosphere prior to allowing an employee to entry: a) 1035 Belleville Turnpike, Kearny, NJ-Portal North RR Bridge Replacement Project (Ballast Tank-End of CAP 2 of Deck Spud Barge "SKANSKA 460012"): Employees were required to enter various permit-required confined spaces (ballast tanks/Mid-body Compartment) to conduct visual internal inspections. The employer did not ensure that continuous forced air ventilation was used to eliminate any hazardous atmosphere conditions prior to allowing affected employees to enter a permit-required confined space, on or about 10/29/24.
