29 CFR  1910.106(e)(6)(ii): Grounding. Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 �F (37.8 �C), shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with:   On or  about October 30, 2024, at a workplace located at 109 Persnickety Place, Kiel, Wisconsin in the Baking Department; Employees dispensing flammable liquid vanilla from the inside of a flammable liquids storage cabinet were not protected from potential fire hazards as the metal barrel and the dispensing container were not electrically interconnected.

29 CFR  1910.178(m)(5)(iii): When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement:   a) On or about October 30, 2024, at a workplace located at 109 Persnickety Place, Kiel, Wisconsin, in the Packaging Department; on Packaging Line 4 a forklift was utilized to elevate product totes above the shaker conveyor hopper and was unattended.   b) On or about October 30, 2024, at a workplace located at 109 Persnickety Place, Kiel, Wisconsin, in the Packaging Department; on Packaging Line 5 a forklift was utilized to elevate product totes above the shaker conveyor hopper and was unattended.

One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.:   a) On or about October 30, 2024, at a workplace located at 109 Persnickety Place, Kiel, Wisconsin in the Packaging Department; On the back of Packaging Line 4, an unguarded pinch point hazard was created by the downward motion of the pouch lifter and the machine base.   b) On or about October 30, 2024, at a workplace located at 109 Persnickety Place, Kiel, Wisconsin in the Packaging Department; On the back of Packaging Line 5, an unguarded pinch point hazard was created by the downward motion of the pouch lifter and the machine base.

Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling.  a) On or about 109 Persnickety Place, Kiel, Wisconsin in the Baking Department; The hanging pendant powering the department scale was not mounted to a fixed surface as required by its listing and labeling.   b) On or about 109 Persnickety Place, Kiel, Wisconsin in the Milling Department; the metal switch and receptacle enclosures hanging from the milling mixer were not mounted to a fixed surface as required by its listing and labeling.
