29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  At the commercial facility located at 210 Kelly Road in Buffalo, Missouri, on October 29, 2024, and at times prior: The employer did not establish a monitoring program for work areas or tasks where employee exposure equaled or exceeded the action level of 85 decibels measured on the A-scale.  Employees were exposed to continuous noise levels higher than 85 dBA in the following areas:  a) Welding - An employee was exposed to continuous noise level at 87.1% dose of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 89 dBA. The sampling was performed for 514 minutes during one shift. b) Dip Tank Area - An employee was exposed to continuous noise level at 152.7% dose of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 87.8 dBA. The sampling was performed for 470 minutes during one shift.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:  At the commercial facility located at 210 Kelly Road in Buffalo, Missouri, on October 29, 2024, and at times prior: The employer did not establish and maintain an audiometric testing program for work areas or tasks where employee exposure equaled or exceeded the action level of 85 decibels measured on the A-scale. The employer did not institute a training program and ensure employee participation in the program:  At the commercial facility located at 210 Kelly Road in Buffalo, Missouri, on October 29, 2024, and at times prior: The employer did not develop and implement a hearing conservation training program for those employees exposed to noise levels at or above an 8-hour time-weighted average of 85 dBA. Employees were exposed to high noise levels in the welding and dip tank areas.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):  At the commercial facility located at 210 Kelly Road in Buffalo, Missouri, on October 29, 2024, and at times prior: Employees were exposed to inhalation, skin and eye irritation, from daily exposure to toxic substances such as carbon black and di-propylene glycol methyl ether. The employer did not develop and implement a written hazard communication program for the workplace to address the hazards associated when working with such chemicals.
