29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  On or about November 1, 2024, at the jobsite located at 8010 Edgerton Rd., North Royalton, Ohio 44133, employees engaged in roofing activity were not protected from fall hazards while working at an elevation of approximately 14 feet above the ground.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On November 1, 2024, at the jobsite located at 8010 Edgerton Rd., North Royalton, Ohio 44133, employees were exposed to eye injury while operating pneumatic roofing nail guns without eye protection while engaged in roofing work.  BENNY TROYER dba BENNY TROYER ROOFING, LLC AND TRAIL ROOFING, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1710289, citation number 01, item number 001 and was affirmed as a final order on 12/27/2023, with respect to a workplace located at 3530 Knollwood Lane, Akron, OH 44333. In this inspection the owner (Benny Troyer) was cited for the same violation, lack of eye protection and corrected it by issuing safety glasses. This showed he was aware of the hazard and its proper abatement.  BENNY TROYER dba BENNY TROYER ROOFING, LLC AND TRAIL ROOFING, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1580529, citation number 02, item number 001 and was affirmed as a final order on 09/14/2022, with respect to a workplace located at 484 Auld Farm Road, Akron, OH 44320. In this inspection , Josh Hostettler was onsite and listed as the foreman, and the owner (Benny Troyer) was cited for the same violation, lack of eye protection and corrected it by issuing safety glasses. This showed he was aware of the hazard and its proper abatement.  BENNY TROYER dba BENNY TROYER ROOFING, LLC AND TRAIL ROOFING, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1517386, citation number 02, item number 001 and was affirmed as a final order on 05/27/2021, with respect to a workplace located at 4571 Massillon Rd, North Canton, OH 44720.  In this inspection the owner (Benny Troyer) was cited for the same violation, lack of eye protection and corrected it by issuing safety glasses. This showed he was aware of the hazard and its proper abatement.  BENNY TROYER dba BENNY TROYER ROOFING, LLC AND TRAIL ROOFING, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1513984, citation number 02, item number 001 and was affirmed as a final order on 03/16/2021, with respect to a workplace located at SL 19 Dogwood Court, North Canton, OH 44720. In this inspection , Josh Hostettler was onsite and listed as the foreman, and the owner (Benny Troyer) was cited for the same violation, lack of eye protection and corrected it by issuing safety glasses. This showed he was aware of the hazard and its proper abatement.  BENNY TROYER dba BENNY TROYER ROOFING, LLC AND TRAIL ROOFING, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1451413, citation number 01, item number 001 and was affirmed as a final order on 4/7/2020, with respect to a workplace located at 1500 Fallen Timber, North Canton, Ohio 44721. In this inspection the owner (Benny Troyer) was cited for the same violation, lack of eye protection and corrected it by issuing safety glasses. This showed he was aware of the hazard and its proper abatement.
