29 CFR  1910.23(c)(8): The employer did not ensure that the cap (if equipped) and top step of a stepladder were not used as steps.   Site- On or about November 1, 2024, an employee accessing the top of a storage container was not protected from a fall hazard where a 6 foot fiberglass step ladder was used to access a working surface approximately 9 feet from the ground. The employee used the top step of the ladder as a step to gain access to the elevated working surface.

29 CFR  1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2m) or more above a lower level was protected from falling by guardrail systems, safety net system, or personal fall arrest system:    Site- On or about November 1, 2024, an employee working from the top of a storage container fell 8 feet 9 inches to the ground, where fall protection was not utilized by the employer.
