29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, falling or flying objects, or from electrical shock and burns were not protected by protective helmets. On or about November 5, 2024, employees of a subcontractor under the control of the General Contractor Mclin Construction, LLC., were on a scaffold installing siding with other crew members working under them without head protection. The General Contractor Superintendent directed the crew on site and allowed them to work without the proper PPE (head protection).

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary. On or about November 5, 2024, employees under the General contractor's control performed siding tasks from a scaffold with spacing between the planks and uprights greater than 1 inch.

29 CFR 1926.451(b)(3): The front edge of all platforms was not 14 inches (36 cm) or less from the face of the work, and no guardrail systems were erected along the front edge and/or no personal fall arrest systems were used in accordance with paragraph (g) of this section to protect employees from falling. On or around November 5, 2024, employees of a subcontractor that were under the control of the General Contractor McLin Construction installed the siding from the third tier of the scaffold at a height greater than 10 feet and more than 14 inches away from the building's face without using fall protection.
