OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing  while working in an active drop zone:  a) On or about November 7, 2024 at 45 South Shore Drive, Dover, Delaware: The employer did not ensure the drop zone was cleared while performing tree trimming operations. An employee was bucking a previously fallen section of the tree in the drop zone while the arborist was in the tree removing another section of the tree. The  approximately 8 foot long tree trunk with a diameter of approximately 24 inches dropped and fell on the employee in the drop zone resulting in fatal injuries.
