29 CFR  1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) Entrance to Sheraton Birmingham Hotel, 2101 Richard Arrington Jr Blvd N, Birmingham: On or about 11/18/2024, the employer exposed employees to fall hazards in that, fall protection was not utilized while employees were standing on the flat roof and receiving sign letters being lifted by a crane.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.501(c):When employees were exposed to falling objects the employer did not require employees to wear hard hats and did not implement measures to prevent objects from falling from higher levels as set forth in (c)(1)-(3) of this section:  (a) Entrance to Sheraton Birmingham Hotel, 2101 Richard Arrington Jr Blvd N, Birmingham: On or about 11/18/2024, the employer exposed employees to struck-by hazards in that, head protection was not utilized while employees were standing at ground level in the area where the crane was lifting sign letters up to the flat roof.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:  (a) Entrance to Sheraton Birmingham Hotel, 2101 Richard Arrington Jr Blvd N, Birmingham, On or about 11/18/2024 and at times prior to, the employer did not have a certification record indicating the status of training for employees exposed to fall hazards.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
