29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition: (a) Agglomeration Area; On or about November 26, 2024, employees were exposed to potential fire and explosion hazards due to insufficient housekeeping practices. The frequency of cleaning did not reduce accumulations of combustible dust on ledges, floors, and equipment. The agglomeration process had poor process containment and did not have sufficient dust collection to capture the large amounts of dust produced during the instantizing procedure for milk and whey powder. (b) Dump Room; On or about November 26, 2024, employees were exposed to potential fire and explosion hazards due to insufficient housekeeping practices. The frequency of cleaning did not reduce accumulations of combustible dust on ledges, floors, and equipment from dumping milk and whey powders into the agglomeration process hopper.

29 CFR 1910.29(b)(10): The employer did not ensure that when guardrail systems are used at hoist areas, a removable guardrail section, consisting of a top rail and midrail, are placed across the access opening between guardrail sections when employees are not performing hoisting operations; and/or the employer used chains or gates instead of a removable guardrail section at hoist areas without the employer demonstrating the chains or gates provide a level of safety equivalent to guardrails: (a) Custom mixing room; On or about the week of November 18, 2024, employees were exposed to 8-foot falls while working on the elevated dump station platform during custom mixing operations because the chains used as a substitute for a guardrail at the hoist area hung lower than the allowable limits for a guardrail system.

(b) Production area, main line; On or about November 26, 2024, the edges of the bag tipping conveyor were not guarded where the conveyor belt and head pulley converge and create an ingoing nip point. (c) Production area, main line; On or about November 26, 2024, the edges on the conveyor upstream from 90-degree turn were not guarded where the conveyor belt and head pulley converge and create an ingoing nip point. (d) Palletizing area, main line; On or about November 26, 2024, the edges on the conveyor upstream from the Phantom scanner conveyor were not guarded where the conveyor belt and head pulley converge and create an ingoing nip point. (e) Custom mixing room; On or about the week of November 18, 2024, while operating the DAY blender, employees were exposed to the auger of the blender when dumping powders into the hopper opening because the bars of the guard were spaced 1.5" apart.
