29 CFR 1910.28(b)(3)(i):  The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D):  a) Welding Shop, Roof over bay #4: On or about 11/27/2024, the employer exposed employees to fall hazards of approximately 22 feet, 8 inches to a lower concrete surface while engaged in power washing activities on a roof. Employees worked near skylights without a fall protection system in place, such as guardrails, covers, or personal fall arrest systems.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  a) Welding Shop: On or about 11/27/2024, and at times prior, employees were exposed to fall hazards of approximately 18 feet to the lower ground level while being lifted to and from the roof using a Case 586E All Terrain Forklift Truck equipped with an unauthorized man basket attachment. The attachment lacked manufacturer approval, identification markings, anchor points for fall protection, and locking mechanisms to secure it to the forks or mast.

29 CFR  1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:    a) Welding Shop: On or about 02/26/2025, and at times prior, the employer exposed employees to struck-by hazards while operating a Case 586E All Terrain Forklift Truck, in that daily inspections identified that the forklift's backup alarms and horns were inoperable and were not repaired or removed from service.
