29 CFR  1926.451(c)(2)(iv):Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  a) Worksite was located at 4/6 Osborn Dune Road, Mantoloking, NJ 08738:  A worker was exposed to fall hazards while working on sheathing a new residential building as they were standing on a supported shop-built scaffold platform while not utilizing fall protection. The scaffold platform that had no sides or guardrails, was supported by a JLG  Model 742 Telehandler, Serial Number 0160099520.  Violation was observed on or about December 3, 2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.451(c)(2)(v):Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  a) Worksite was located at 4/6 Osborn Dune Road, Mantoloking, NJ 08738:  A worker was exposed to fall hazards while working on sheathing a new residential building as they were standing on a supported shop-built scaffold platform that was not secured to the telehandler.  The telehandler was moved into position for the worker while the worker stood on the platform. The scaffold platform was supported by a JLG Model 742 Telehandler, Serial Number 0160099520.   Violation was observed on or about December 3, 2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) Worksite was located at 4/6 Osborn Dune Road, Mantoloking, NJ 08738:  A worker was exposed to fall hazards of approximately forty five feet to ground as they were sheathing the roof  of a new four-story residence while not utilizing fall protection.  Violation was observed on or about December 3, 2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
