29 CFR  1926.451(c)(2)(iv):Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  a) The worksite was located at 242 Strickland Blvd., Lavallette, NJ 08735:  A contractor's worker was exposed to fall hazards of approximately three-stories to ground while sheathing the frame of a new elevated three-story single-family residence. The worker was standing in a shop built trash hopper the crew was using as a scaffold platform that had  one open side without fall protection while elevated by a Genie GTH 844 Telehandler.  Violation was observed on or about December 3, 2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

The telehandler had been moved into position for the worker to perform the sheathing while the worker was in the box.  Violation was observed on or about December 3, 2024.
