29 CFR  1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  (a) Production - On or about November 10, 2024, the employer failed to establish a Lockout Tagout Program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on machines, such as but not limited to the DoAll Horizontal saw during blade changes, where the unexpected energization, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  (a) Facility Wide - On February 18, 2025, the employer failed to ensure that each powered industrial truck operator's operational performance was evaluated and documented at least once every three years.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR  1910.178(l)(6):The certification did not include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation:  (a) Facility Wide - On February 18, 2025, the employer did not certify that each forklift truck operator had been evaluated as required by paragraph (l), with certification records that includes the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the evaluation.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
