29 CFR  1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:   a) On or about 07/28/2025:  The employer did not provide abatement certification for items within the settlement agreement required to abate Citation 01, Item 001 which became a final order on July 17, 2025.  An abatement demand letter was sent to the employer on July 18, 2025.  Abatement certification is required for this item.

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  a) 6173 Palisades Drive, Cicero, NY  13039.  On or about December 5, 2024, employees were installing roofing materials onto an 8:12 pitch residential roof, with a ground to eave height of 26 feet without the employer providing documentation of fall protection training.    Abatement documentation must be submitted for this item.
