29 CFR  1926.300(b)(1):When power operated tools are designed to accommodate guards, they shall be equipped with such guards when in use.  a) 215 35th St., Brigantine, NJ: An employee was operating an unguarded Dewalt table saw. The employee would operate the table saw to cut siding tile. This action occurred numerous times throughout the day. Observed 12/12/24.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level.  a)215 35th St. Brigantine, NJ: Two individuals were observed approximately twenty to twenty-five feet above the ground on a Pump Jack Scaffold. Both employees were not protected by personal fall protection or a completed scaffold system with end caps and properly placed safety nets. Observed on or about 12/12/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
