29 CFR  1926.1053(b)(1): Where portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  (a) On or about December 13, 2024, employees utilizing a multipurpose ladder to access the roof from the second level did not extend at least three feet above the upper landing nor was it secured to prevent displacement while used. Exposing employees to a fall hazard of approximately 8 feet onto the second level.

(a) On or about December 13, 2024, the employer did not ensure frequent and regular inspections of the job site were conducted by a competent person to ensure hazardous conditions were found and corrected. Hazards identified included but were not limited to, fall protection not being utilized and ladder not installed and/or used properly, exposing employees to fall hazards.  Christian Dominguez DBA WXK Framing was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1490203, citation number 1, item number 1 and was affirmed as a final order on February 8, 2021, with respect to a workplace located at 1035 Pinehurst Ct., Brookfield, WI 53005.

(a) On or about December 13, 2024, the employer had not ensured that employees installing sheathing on a new commercial property with a 6:12 pitch, had been trained to recognize and minimize the fall hazards associated with their work.
