OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards involving the disposal of aerosol spray paint cans into a waste container: On or about December 16, 2024, the employer did not ensure safe working conditions at the jobsite during the process of employees emptying aerosol cans in the North Building. Employees would purge aerosol cans into a waste container by using a lever to press the cans onto a drill bit, puncturing them. As a result, employees were exposed to struck-by hazards from aerosol cans that were not fully emptied, causing them to potentially launch away from the waste container.
