OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards involving the disposal of aerosol spray paint cans into a waste container: On or about December 16, 2024, the employer did not ensure safe working conditions at the jobsite during the process of employees emptying aerosol cans in the North Building. Employees would purge aerosol cans into a waste container by using a lever to press the cans onto a drill bit, puncturing them. As a result, employees were exposed to struck-by hazards from aerosol cans that were not fully emptied, causing them to potentially launch away from the waste container.

29 CFR 1910.106(b)(6): "Sources of ignition." In locations where flammable vapors may be present, precautions shall be taken to prevent ignition by eliminating or controlling sources of ignition. Sources of ignition may include open flames, lightning, smoking, cutting and welding, hot surfaces, frictional heat, sparks (static, electrical, and mechanical), spontaneous ignition, chemical and physical-chemical reactions, and radiant heat. On or about December 16, 2024, employees were exposed to flammable vapors in the 'Tinter's Row' Room of the North Building. The presence of these vapors was attributed (but not limited) to the purging of aerosol cans. The employer did not ensure sufficient safeguards were in place to prevent sparks generated by the frictional heat of steel aerosol cans from making contact with the surrounding environment, including (but not limited to) steel Intermediate Bulk Container (IBC) totes as well as the concrete floor.
