29 CFR  1910.178(p)(1):  Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):  Employees were exposed to struck-by hazards.  Employees engaged in material handing activities using the Caterpillar forklift, were exposed to struck-by hazards in that forklift was not taken out of service when it was found to be in need of repair for a nonfunctioning horn.

29 CFR  1910.212(a)(1):  One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a)  Employees were exposed to amputation and struck-by hazards.  Employees engaged in fabrication activities in the manufacturing department located at 1034 S. 8th Street, Kansas City, Kansas were operating the Komatsu Horizontal Band Saw that exposed employees to amputation hazards in that machine guarding was not provided for the unused section of the rotating blade.  (b)  Employees were exposed to amputation and struck-by hazards.  Employees engaged in fabrication activities in the manufacturing department located at 1034 S. 8th Street, Kansas City, Kansas were operating the Roll-In Band Saw that exposed employees to amputation hazards in that machine guarding was not provided for the unused section of the rotating blade  (c)  Employees were exposed to amputation and struck-by hazards.  Employees engaged in fabrication activities in the manufacturing department located at 1034 S. 8th Street, Kansas City, Kansas were operating the Mori Seiki CNC machine that exposed employees to struck-by hazards in that door on the left side of the machine had been removed, thus exposing employees to rotating parts.  (d)  Employees were exposed to amputation and struck-by hazards.  Employees engaged in fabrication activities in the manufacturing department located at 1034 S. 8th Street, Kansas City, Kansas were operating the MV45 that exposed employees to struck-by hazards in that machine guarding was not provided for the tool changer rotating parts.
