29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a) Located at 2180 Overlook Way, Newark OH, 43055: On or about December 20, 2024, the employer did not ensure the ladder's side rails extended 3 feet above the landing for employees who accessed the top of the first level of the residential home while framing. An employee utilized an extension ladder on the front of the garage that did not reach the second level, exposing employees to a fall height of more than 14 feet.  b) Located at 2180 Overlook Way, Newark OH, 43055: On or about December 20, 2024, the employer did not ensure the ladder's side rails extended 3 feet above the landing for employees who accessed the top of the first level of the residential home while framing. Employees utilized an extension ladder on the east wall of the garage that did not reach the second level, exposing employees to a fall height of more than 13 feet.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) Located at 2180 Overlook Way, Newark, OH 43055:On or about December 20, 2024, the employer did not ensure that employees framing were protected from falling by a fall protection system. As a result, employees were exposed to a fall hazard of greater than 25 feet while performing residential construction.  MD Construction Solution LLC was previously cited under the name David Estuardo Ramirez for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1569141, citation number 1, item number 5 and was affirmed as a final order on July 5, 2022, with respect to a workplace located at Lot 298 at Ellington Village, Granville, Ohio 43023.  MD Construction Solution LLC was previously cited under the name David Estuardo Ramirez for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1633563, citation number 1, item number 3 and was affirmed as a final order on February 1, 2023, with respect to a workplace located at 188 Beaman Gates Dr SW, Lot 347EL, Pataskala, OH 43062.

29 CFR  1926.20(b)(2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a) Located at 2180 Overlook Way, Newark OH, 43055: On or about December 20, 2024, the employer did not conduct frequent and regular inspections of the job site. As a result, employees were exposed to fall hazards greater than 25 feet while performing residential construction.  MD Construction Solution LLC was previously cited under the name David Estuardo Ramirez for a violation of its equivalent Occupational Safety and Health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1633563, citation number 1, item number 1 and was affirmed as a final order on February 1, 2023, with respect to a workplace located at 188 Beaman Gates Dr SW, Lot 347EL, Pataskala, OH 43062.  MD Construction Solution LLC was previously cited under the name David Estuardo Ramirez for a violation of its equivalent Occupational Safety and Health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1569141, citation number 1, item number 1 and was affirmed as a final order on July 5, 2022, with respect to a workplace located at Mayfield Drive, Lot 298, Granville, OH 43023.

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) Located at 2180 Overlook Way, Newark, OH 43055: On or about December 20, 2024, the employer failed to ensure that each employee exposed to a fall hazard was trained on the hazards of falling and the procedures to minimize the hazards in the work area. As a result, employees were exposed to fall hazards greater than 25 feet while performing residential construction.
