OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and crushing hazards associated with the lack of inspections on four two-post automotive lifts as a part of conducting annual inspections:  (a)Dr. Phil's Car Club LLC at 301 West 43rd Street, Sioux Falls, SD 57105: On or about and at times prior to December 19, 2024, the employer did not inspect the Eagle Equipment Automotive Lift, Model TP-7AN, s/n: E121693510 for defects; exposing employees to struck-by and crushing hazards from falling loads in the event of lift failure. This condition exposed employees to struck-by and crushing hazards.   (b)Dr. Phil's Car Club LLC at 301 West 43rd Street, Sioux Falls, SD 57105: On or about and at times prior to December 19, 2024, the employer did not inspect the Nubbaum Hebetechnik Automotive Lift, Model SPL8000, s/n: 122060 for defects; exposing employees to struck-by and crushing hazards from falling loads in the event of lift failure. This condition exposed employees to struck-by and crushing hazards.  (c)Dr. Phil's Car Club LLC at 301 West 43rd Street, Sioux Falls, SD 57105: On or about and at times prior to December 19, 2024, the employer did not inspect the Nubbaum Hebetechnik Automotive Lift, Model SPL 8000, s/n: 122056 for defects; exposing employees to struck-by and crushing hazards from falling loads in the event of lift failure. This condition exposed employees to struck-by and crushing hazards.  (d)Dr. Phil's Car Club LLC at 301 West 43rd Street, Sioux Falls, SD 57105: On or about and at times prior to December 19, 2024, the employer did not inspect the Eagle Equipment Automotive Lift, Model TP-7AN, s/n: T110993398 for defects; exposing employees to struck-by and crushing hazards from falling loads in the event of lift failure. This condition exposed employees to struck-by and crushing hazards.  Abatement Note: Among others, the following are feasible and acceptable abatement methods to abate the hazard:   1) Institute a preventative maintenance program in accordance with ANSI/ALI ALOIM.  2) Ensure employees do not use automotive lifts with deficient safety devices.  3) Ensure unsafe lifts are effectively locked out until repairs can be made by qualified personnel.

29 CFR  1910.303(g)(1): Sufficient access and working space was not provided and maintained about all electric equipment (operating at 600 volts, nominal, or less to ground) to permit ready and safe operation and maintenance of such equipment:  (a)Dr. Phil's Car Club LLC at 301 West 43rd Street, Sioux Falls, SD 57105: On or about and at times prior to December 19, 2024, the employer did not ensure adequate access to an electrical panel behind rolling toolboxes on the west wall of the shop.  This condition exposed employees potential shock and electrocution hazards related to inability to disable power during an emergency.

This condition exposed employees to electrical shock and fire hazards.

29 CFR  1910.334(a)(2)(ii):There was a defect or evidence of damage that could have exposed an employee to injury and the defective or damaged item was not removed from service and an employee was using it before repairs and tests necessary to render the equipment safe were made:  (a)Dr. Phil's Car Club LLC at 301 West 43rd Street, Sioux Falls, SD 57105: On or about and at times prior to December 19, 2024, the employer did not ensure that employees were protected from electrical shock in that a flexible extension cord located at the west wall of the shop had been improperly repaired and patched with electrical tape.  This condition exposed employees to shock and burn hazards.
