29 CFR 1910.22(a)(1): Place(s) of employment were not kept clean  a) On or about 01/08/2025, in the Railcar Loadout Area, where employees load sugar into the bucket elevator, a hazardous buildup of combustible sugar dust was present on floors, walls, surfaces, and electrical installations exposing employees to fire and explosion hazards.  b) On or about 01/08/2025, in the Bagging Area, where employees pour sugar into bags, a hazardous buildup of combustible sugar dust was present on floors, beams, surfaces, and electrical components exposing employees to fire and explosion hazards. 29 CFR 1910.28(b)(3)(iv): The employer did not ensure each employee was protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toe boards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used.  a) On or about 01/08/2025 in the Bagging Area, employees were exposed to a fall hazard of approximately 11 feet when the top of the ladderway used to access the platform was open without any protection from falling into the opening at the top of the ladder. 29 CFR 1910.178(c)(2)(vii):  Power-operated industrial trucks designated as DY, EE, or EX were not used in atmospheres in which combustible dust is not normally in suspension in the air by normal operation of equipment or apparatus but where deposits or accumulations of such dust could be ignited by arcs or sparks originating in the truck.  a) On or about 01/08/2025, throughout the Powerhouse Building, LP gas-powered industrial trucks, such as but not limited to Toyota LP gas-powered forklifts, were used where hazardous dust accumulation of sugar could be ignited by arcs or sparks originating in the truck.  Accumulations of combustible dust were present during normal operating conditions.  ABATEMENT CERTIFICATION REQUIRED

29 CFR  1910.253(b)(4)(iii): Oxygen cylinders in storage were not separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour:  a) On or about 01/08/2025, in the Railcar Loadout Area where hazardous buildup of combustible sugar dust was present, oxygen and acetylene compressed gas cylinders were being stored together in lieu of being separated by a minimum distance of 20 feet or by a noncombustible barrier at least 5 feet high having a fire-resistance rating of at least one-half hour. 29 CFR  1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location:  a) On or about 01/08/2025, throughout the Powerhouse Building, electrical equipment including but not limited to, outlets, light switches, motors, light fixtures, electrical disconnects, and control panels were covered with a hazardous buildup of combustible sugar dust. This electrical equipment was located in a Class II Division I location and, was not intrinsically safe, approved for use in a Class II Division I location, or safe for use in a Class II, Division I location.  b) On or about 01/08/2025, in the Railcar Loadout Area, the sifter starter was missing its cover, leaving energized wires exposed and covered with a hazardous buildup of combustible sugar dust. This electrical equipment was located in a Class II Division I location and, was not intrinsically safe, approved for use in a Class II Division I location, or safe for use in a Class II Division I location.  c) On or about 01/08/2025, throughout the Powerhouse Building, electrical equipment including but not limited to, a sweeper attachment and portable hand-held blower were used to clean the buildup of combustible sugar dust. The electrical equipment was not intrinsically safe, or approved for use in a Class II Division I location, or safe for use in a Class II Division I location.  ABATEMENT DOCUMENTATION REQUIRED
