29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  On or about January 17, 2025 and at times prior, daily inspections of an excavation located near the west side of South 92nd E Ave  and E 21st street, were not conducted to ensure conditions did not exist that could result in possible cave-ins.

29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  On or about January 17, 2025 and at times prior,  employees performing excavation operations and water line installations  near the west side of South 92nd E Ave  and E 21st street, were not provided with adequate cave-in protective systems while working at depths greater than five (5 ) feet.
