29 CFR 1910.176(a): Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. a) On or about January 22, 2025, the employer failed to ensure that permanent aisles were appropriately marked to separate pedestrian traffic from forklift operations. As a result, employees walking in the aisle were exposed to struck-by hazards from a Yale forklift operating in the same unmarked travel path.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training and evaluation: Refresher training in relevant topics shall be provided to the operator when: The operator has been involved in an accident or near-miss incident; a) On or about January 22, 2025, the employer failed to provide required refresher training and evaluation to forklift operators involved in an accident before allowing them to continue operating forklifts. As a result, employees were exposed to struck-by hazards due to unaddressed deficiencies in forklift operation.

29 CFR 1910.178(n)(6): The driver shall be required to look in the direction of, and keep a clear view of the path of travel. a) On or about January 22, 2025, the employer failed to ensure that forklift operators maintained an unobstructed view while traveling. A Yale forklift operator was driving forward with a load that obstructed their line of sight, resulting in the operator striking an employee standing in the travel path.
