The employer required employees to wear respirators when applying corrosive and flammable coatings to household structures during remediation of fire, water, or mold damage.    All provisions of 29CFR 1910.134(c) through (o) must be covered in a respiratory protection program.  Key elements include but are not limited to the following:      1.  Selection of respirators for employees.     2.  Medical evaluations for employees.     3.  Fit testing.     4.  Training and information.     5.  Recordkeeping.

29 CFR 1910.134(h)(1)(i):  Respirators issued for the exclusive use of an employee shall be cleaned and disinfected as often as necessary to be maintained in a sanitary condition:  On or about January 29, 2025, at the establishment located at 7577 Blacktop Road, Neenah, Wisconsin; the employer did not ensure a Painter employee's tight-fitting full-face respirator was cleaned and disinfected as often as necessary to be maintained in a sanitary condition. The employee's respirator had accumulations of overspray from when the employee was applying corrosive and flammable coatings to household structures during remediation of fire, water, or mold damage.

29 CFR 1910.134(h)(2)(i):  All respirators shall be stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals, and they shall be packed or stored to prevent deformation of the facepiece and exhalation valve:  On or about January 29, 2025, at the establishment located at 7577 Blacktop Road, Neenah, Wisconsin; the employer did not ensure an employee had stored their respirator to protect it from contamination, dust, and damaging chemicals. The employee left their respirator on the workbench in the paint area at the end of the day.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  On or about January 29, 2025, at the establishment located at 7577 Blacktop Road, Neenah, Wisconsin; the employer did not provide employees with effective information and training on hazardous chemicals in their work areas at the time of their initial assignments. Employees were not trained on the hazards of the chemicals that they worked with, nor were they trained on the availability or location of safety data sheets (SDS).  Employees were exposed to flammable and corrosive chemicals that could possibly cause allergic skin reactions, genetic defects, cancer, skin burns, eye damage, and damage to lungs. The employer had assessed the workplace and determined that a full-face respirator, protective clothing, protective gloves, and steel toed shoes were necessary for the safety of employees, but could not provide a signed, written certification of the assessment.
