29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) Production Area - 171 North Range Street. Dothan, AL.: On or about January 28, 2025, and at times prior, the employer exposed employees to struck-by hazards in that employees were allowed to operate a forklift without the employer first ensuring that employees were competent to operate the equipment as demonstrated by the completion of the required training and evaluation specified in the regulation.

29 CFR  1910.132(d)(2):The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed:  a) Production Area - 171 North Range Street. Dothan, AL. : On or about January 28, 2025 and times prior the employer failed to verify that the required workplace hazard assessment had been performed through a written certification that identified the workplace evaluated, the person certifying that the evaluation had been performed, the date(s) of the hazard assessment, and which identified the document as a certification of hazard assessment.
