29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a)  On or about February 3, 2025, and at times prior, the employer did not develop and implement a written respirator protection program with required worksite-specific procedures and elements for employees required to wear half-face tight fitting respirators. Employees are required to wear half-face respirators while performing paint gun/booth painting operations and when using body filler during autobody refinishing, exposing employees to the physiological burden of wearing a respirator, and improper use of respiratory protection due to the lack of a written respiratory protection program. 29 CFR  1910.134(d)(3)(iii)(B)(2): The employer did not implement a change schedule for respirators not equipped with an End of Service Life Indicator that would ensure cartridges were changed before the end of their service life:    a)  On or about February 3, 2025, and at times prior, employees were exposed to inhalation hazards while performing paint gun/booth painting operations. The employer failed to ensure the cartridges were changed out regularly so that saturation didn't occur as gas and vapor cartridges have a limited lifespan, and their ability to absorb contaminants diminishes as they become saturated, potentially leading to "breakthrough" where contaminants pass through the filter. The cartridges connected to the respirator within the paint booth mixing room were completely saturated with wear and tear and showed signs of damage. The employer did not provide medical evaluations to determine the employee's ability to use a respirator prior to requiring employees to wear half mask tight fitting respirators during auto painting, exposing employees to physiological burden.
