OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were operating forklifts without wearing seat belts. a) For the service area and yard, on or about 02/05/2025, the employer exposed employees to crushing hazards in the event of a forklift tip-over or being ejected from the forklift, in that, the wearing of seat belts while operating forklifts was not enforced. Employees routinely operated forklifts without wearing seat belts.
