29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) New single-family residential structure located on Lot #181 at 5253 Frontier Court, Flowery Branch, GA 30542, Second floor: On or about 02/05/2025, the employer exposed employees to fall hazards of approximately 10-feet, 9-inches to the lower ground level, in that an adequate fall protection system was not utilized while working from the second-story area.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) New single-family residential structure located on Lot #81 at 5253 Frontier Court, Flowery Branch, GA 30542, Ground level: On or about 02/05/2025, the employer exposed employees to fall hazards up to 10-feet, 4-inches to the lower level in that the portable extension ladder used to access the upper working area did not have side rails extending at least three feet above the upper landing area.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:  a) New single-family residential structure located on Lot #181 at 5253 Frontier Court, Flowery Branch, GA 30542, Ground level: On or about 02/05/2025, the employer exposed employees to fall hazards up to 10-feet, 4-inches to the lower level in that employees were utilizing the top step of a 6-foot self-supporting ladder to gain access to the upper working area as the ladder provided had a maximum height of 5-feet, 10-inches.
