29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  (a)Flatland Excavating at 14304 Daughenbaugh Road, Hermosa, SD 57744:  On or about and at times prior to February 7, 2025, the employer did not ensure that daily inspections of the excavations were conducted by a competent person.  This condition exposed employees to various hazards associated with lack of protective systems, spoils piles, egress, personal protective equipment, and lack of training.

29 CFR  1926.651(l):Walkways were not provided where employees or equipment were required or permitted to cross over excavations:  (a)Flatland Excavating at 14304 Daughenbaugh Road, Hermosa, SD 57744:  On or about and at times prior to February 6, 2025, the employer did not ensure adequate walkways were provided to allow employees to safely cross over excavations greater than five feet in depth.  This condition exposed the employees to fall hazards and cave-in hazards.
