29 CFR 1910.147(c)(4)(ii):The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following: (A) A specific statement of the intended use of the procedure; (B) Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy; (C) Specific procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them; and a) On or about 2/4/2025, the employer did not ensure that the machine specific lock out procedures for equipment including, but not limited too; the AIDA (model # NC1-1500(2)E) SER # C0415-1735) contained the requirements of (A) through (C), a specific statement of the intended use and procedural steps for shutting down and isolating hazardous energy sources such as stored pneumatic on the ejector, and did not provide the type and the placement of the lockout devices for the ejectors, employees were exposed to potential caught-in hazards while performing servicing and/or maintenance such as the clearing stuck parts.

29 CFR 1910.147(c)(6)(i):The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed. (A) The periodic inspection shall be performed by an authorized employee other than the ones(s) utilizing the energy control procedure being inspected. (B) The periodic inspection shall be conducted to correct any deviations or inadequacies identified. (C) Where lockout is used for energy control, the periodic inspection shall include a review, between the inspector and each authorized employee, of that employee's responsibilities under the energy control procedure being inspected. a) On or before 2/4/2025 the employer did not conduct periodic inspection of each energy control procedures annually, for equipment such as but not limited to; the energy control procedures for the AIDA (model # NC1-1500(2)E) SER # C0415-1735), to ensure that the documented machine specific procedure was adequate to prevent exposure to moving parts including auxiliary equipment of the mechanical power press.

The employer shall: (i) Use dies and operating methods designed to control or eliminate hazards to operating personnel, and (ii) furnish and enforce the use of hand tools for freeing and removing stuck work or scrap pieces from the die, so that no employee need reach into the point of operation for such purposes. a) On or before 2/4/2025, the employer did not ensure that operators working equipment such as the part revolution mechanical power press AIDA (model # NC1-1500(2)E) SER # C0415-1735) had the means to clear stuck parts and that the employer enforced the use of such tools, in that employees were reaching into the point of operation to clear the stuck parts from the ejector with their hands, employees were exposed to a caught-in hazard during this process once the stuck part is removed and the ejector activates.

29 CFR 1910.217(e)(1)(i): It shall be the responsibility of the employer to establish and follow a program of periodic and regular inspections of his power presses to ensure that all their parts, auxiliary equipment, and safeguards are in a safe operating condition and adjustment. The employer shall maintain a certification record of inspections which includes the date of inspection, the signature of the person who performed the inspection and the serial number, or other identifier, of the power press that was inspected. (A) Conduct periodic and regular inspections of each power press to ensure that all of its parts, auxiliary equipment, and safeguards, including the clutch/brake mechanism, anti-repeat feature, and single-stroke mechanism, are in a safe operating condition and adjustment; a) On or before 2/4/2025, the employer did not ensure that periodic inspection were being conducted on power presses such as but not limited to the AIDA (model # NC1-1500(2)E) SER # C0415-1735) included that the air pressure allowed the ejector to operate even after employees broke the light curtains path, exposing employees to a caught in hazard while removing stuck parts.

29 CFR 1910.217(f)(2):Instruction to operators. The employer shall train and instruct the operator in the safe method of work before starting work on any operation covered by this section. The employer shall insure by adequate supervision that correct operating procedures are being followed. (a) On or about 2/4/2025 operators for part revolution presses such as the AIDA (model # NC1-1500(2)E) SER # C0415-1735) were not adequately instructed to utilize tools to remove stuck parts from the ejectors. Nor were the operators informed that when stuck parts were removed from the ejectors that the ejectors would still function even with the light curtain being activated.
