OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards:  On or about February 11, 2025, employees were exposed to the following conditions:   a) Struck-by hazards where the diagonal beam of a storage rack in the fulfillment production area was bent and had pallets of product weighing up to 4200 lbs., stored on middle and top shelves.  b) Struck-by hazards where storage racks in the fulfilment production area did not have load capacity ratings.

29 CFR  1910.147(c)(1):The employer did not establish a program consisting of an energy control procedures, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a)  Huckleberry Roasters, Roasting Production: On or about February 11, 2025, the employer did not establish energy control procedures and implement employee training to ensure that employees performing any servicing or maintenance on machines or equipment where the unexpected energizing, start up, or release of stored energy could occur and cause injury, the machine or equipment would be isolated from the energy source. Employees were exposed to caught in hazards from the unexpected energization of the Giesen W15 (SN W15/2013755) and Loring S70 (SN S70T-002180) Roasters, which use both electric and gas energy, while performing maintenance activities.
