29 CFR 1926.102(a)(1):  The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects while using a nail gun:  a)  On the first story top plate, on a newly constructed residential house, located at 149 Kingswood Cir, Lot 149, Bloomingdale, GA, on or about February 12, 2025, the employer exposed employees to struck-by hazards, in that the use of eye protection was not enforced for employees using pneumatic nail guns while performing framing activities.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  On the first story top plate, on a newly constructed residential house, located at 149 Kingswood Cir, Lot 149, Bloomingdale, GA, on or about February 12, 2025, the employer exposed employees to fall hazards, in that the use of fall protection was not enforced for employees performing framing activities at heights exceeding 11 feet.

29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a)  At a newly constructed residential house, located at 149 Kingswood Cir, Lot 149, Bloomingdale, GA, on or about February 12, 2025, the employer exposed employees to fall hazards, in that a ladder used by employees to access and egress the first story top plate of a residential house, to perform framing work, was not properly adjusted for the side rails to extend at least three feet above the upper landing surface.

29 CFR 1926.1053(b)(16):  Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:  a)  At a newly constructed residential house, located at 149 Kingswood Cir, Lot 149, Bloomingdale, GA, on or about February 12, 2025, the employer exposed employees to fall hazards, in that the employer did not remove from service a ladder with visible structural defects to the right rail used by employees to access and egress the first story top plate of a residential house to perform framing work.
