OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush by hazards:   (a) On February 21, 2025, and times prior at or 1200 Industrial Drive in Bismarck, North Dakota, employees were exposed to crush by hazards while working in close proximity to industrial racking that were not secured against toppling, and not rated for load capacity.  Note: Among other methods, one feasible and acceptable abatement method to correct this hazard include but are not limited to: Follow ANSI MH16.1 Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks, specifically section 1.4: Integrity Of Rack Installations which provides for the proper installation and use of industrial racking including: anchoring of column base plates and labeling of load ratings.
